These are the terms and conditions of use (the “Terms”) for www.portmeiriongroup.com (the “Site”). The Site is owned and operated by Portmeirion Group PLC (“we”, “our” or “us”), the parent company of the wider Portmeirion Group.

The pages, or parts of pages, containing share price information are published by Design Portfolio on behalf of Portmeirion Group PLC and are distinct from those published by Portmeirion Group UK Limited or other subsidiary companies in the Portmeirion Group. Any Site pages containing share price data, charts and Regulatory News Service (RNS) announcements are provided by Design Portfolio from the London Stock Exchange via trusted third-party data providers. The mouse is difficult to use – how can I get around the website?

Use of the Site

You agree to fully indemnify, and keep indemnified, us, our officers, directors, employees, agents and suppliers immediately on demand from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach by you of the use of these Terms or any other liabilities arising out of your use of the Site, or the use by any other person accessing the Site using your personal information.

Waiver

If we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

Entire Agreement

You agree that you shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in these Terms. You shall have no claim for innocent or negligent misrepresentation based upon any statement in the Terms. Nothing in this clause shall limit or exclude any liability for fraud.

Jurisdiction

These Terms shall be governed by and construed in accordance with the law of England and Wales. This means any dispute or claim arising out of or in connection with it will be governed by English law. You and we agree that the courts of England and Wales will have exclusive jurisdiction, subject to the exceptions below if you reside outside of England and Wales.
If you are a resident of Scotland you may bring proceedings either in Scotland or in England and Wales.  If you are a resident of Northern Ireland you may bring proceedings either in Northern Ireland or in England and Wales.

If you are a consumer residing in an EU member state other than the UK, you may bring proceedings in either that state or in England and Wales, but we may only bring proceedings against you in the state in which you reside.
